The following terms and conditions apply to Socket Mobile’s Advanced Replacement Service (“Advanced Replacement Service”) provided in conjunction with any services offered under Socket Mobile Limited Warranty and any of the Socket Mobile Extended Warranty plans. This service is additional to the options available at no charge under Socket Mobile, Inc’s Standard Warranty and does not otherwise affect your statutory rights.
i. Advance Replacement Service can minimize the amount of time you are without your Socket Mobile, Inc (“Socket Mobile”) product.If you choose to use this Service, Socket Mobile will send you a Replacement Product to replace your original product that has become defective (“Original Product”).
ii. If your Original Product is still covered under a Socket Mobile plan namely Standard Limited Warranty, Standard Extended Warranty, Extended Warranty with One Time Accidental or Premium Extended Warranty, and you return your Original Product such that Socket Mobile receives it within thirty (30) days from the date Socket Mobile ships the Replacement Product (the “Return Period”) you will only have to pay the Advanced Replacement Shipping Charge. IF SOCKET MOBILE DETERMINES THAT YOUR ORIGINAL PRODUCT IS NOT COVERED BY A SOCKET MOBILE WARRANTY OR IF THE PRODUCT IS NOT SHIPPED WITHIN THE RETURN PERIOD, then YOU WILL BE CHARGED Socket Mobile’s Retail Price of the Replacement Product. All charges referred to herein shall include all applicable taxes.
iii. If your Socket Mobile Original Product becomes defective within the first 30 days of ownership Socket Mobile will replace the defective Original Product with a brand-new Replacement Product with a minimum of 12 months manufacturer’s warranty.
iv. If your Socket Mobile Original Product becomes defective after 30 days of ownership, but before the expiration date of the Socket Mobile Limited or Extended Warranty for the Original Product, Socket Mobile will replace the Original Product with a manufacturer’s refurbished Replacement Product with either a 90 days manufacturer’s warranty or with the remaining portion of the warranty from the Original Product plus 90 days, provided the serial number of the Replacement Product is provided to Socket Mobile when the Replacement Product is received by the end user.
v. When you order Advanced Replacement Service, you will provide to Socket Mobile your credit card details. Socket Mobile will ship the Replacement Product to your designated location and will charge your credit card the Advanced Replacement Shipping Charge displayed at the time of selecting available shipping options and the Service Charge, if applicable, at the time the Replacement Product ships.
vi. You must return your Original Product such that Socket Mobile receives it within the Return Period. You must also return the Original Product in the package that contained the Replacement Product in accordance with Socket Mobile instructions. Socket Mobile will retain the Original Product and you will retain the Replacement Product.
vii. If your Original Product is warranted under the Extended Warranty with One Time Accidental Warranty plan and not under any other Socket Warranty Plan, under this Advanced Replacement Service, at the time of the shipping of the Replacement Product, your credit card will also be charged the applicable Service Fee as outlined here. Should your Original Product be found to be defective due to Manufacturers failure rather than due to Accidental Damage, the Service Charge will be refunded to your credit card.
viii. In addition, at the time the Replacement Product ships, Socket Mobile will affect DEPOSIT against your credit card equal to the Socket Mobile retail price, excluding taxes, of a new Product (“Replacement Value”).Current Product prices can be viewed at www.socketmobile.eu. This DEPOSIT will be maintained by Socket Mobile. Socket Mobile will apply against your credit card for (i) the Replacement Value if your Original Product is not eligible for Product Replacement under this Advanced Replacement Service; and (ii) the value of any charges that you owe Socket Mobile under this Advanced Replacement Service. Conditions for ineligibility for this Service include, without limitation:
(a) Any damage to the Original Product that is not covered by a Socket Mobile warranty. Some of the conditions that Socket Mobile warranty does not cover:
- Expiration of the term of the warranty;
- The Product has been modified or repaired by non-authorized personel;
- The Product was used outside the published specifications (e.g water damage on SocketScan Series);
(b) Loss of the Original Product; and
(c) Socket Mobile does not receive the original product within the Return Period.
ix. If Socket Mobile determines that your Original Product is eligible for a free Replacement Product under the Advance Replacement Service, your credit card DEPOSIT will be refunded, and you will owe Socket Mobile no other fees or charges under the Advance Replacement Service. In addition, after confirmation that all charges owed to Socket Mobile have been paid, the DEPOSIT on your credit card will also expire.
x. Socket Mobile will refund any DEPOSIT if the defective scanner is deemed to be ELIGIBLE FOR REPLACEMENT and is returned within 30 days of the Replacement Product being dispatched.
xi. Socket Mobile will start the DEPOSIT refund process the Friday following receipt and acceptance of a defective scanner that is deemed to be ELIGIBLE for replacement.
xii. Socket Mobile is not responsible for the time it takes any associated Merchant to process the refund and apply it to a customer’s credit or debit card.
xiii. In the event of any dispute regarding any of the previously mentioned points the decision of Socket Mobile will be final and cannot be appealed.
